This document specifies the Terms of Use by which customers using this KIX DUTY FREE KIX Direct management duty-free-shop Advance reservations site (hereafter "this Site") administrated by Kansai Airports Retail & Services (hereafter "us", "we", "our") agree to be bound.

Article 1 (Definitions)

1. "Member" refers to a person who have completed the membership registration set forth in Article 5 and who is capable of using the services provided in this Site (hereafter "the Services") on an ongoing basis.
2. "Non-member" refers to a person who use the Services without completing the membership registration set forth in Article 5.
3. "User" is the collective term used to describe both Members and Non-members.
4. "Member Information" refers to information about a Member that said Member registers with us when completing the Member registration set forth in Article 5 (including subsequent revisions thereto), and information about the history of transactions with that Member.
5. "User Information" refers to Member Information, information about Non-members entered by Non-members when using this Site, and information on the history concerning Non-member transactions, etc.

Article 2 (Application)

These Terms of Use apply to all matters pertaining to the use of this Site by Users.

Article 3 (Suspension, etc. of Service)

1. In order to maintain the Services offered by this Site in good condition, this site will suspend the provision of all or part of this Services without prior warning to Users if any of the followings apply. If:
   ⑴ it is necessary for the purposes of regular or emergency system maintenance
   ⑵ there is a concentrated load on the system
   ⑶ it is difficult to operate the system due to unforeseen accidents such as fire, power outages, and natural disasters (such as earthquakes, storm and flood damage, and lightning strike), or sabotage by a third party
   ⑷ we otherwise determine it necessary to suspend the system for unavoidable reasons
   
   
2. We assume no responsibility whatsoever for any disadvantage or damages suffered by Users or third parties due to suspension of provision of the Services.

Article 4 (Changes to or Discontinuation of Services)

We reserve the right to change or discontinue all or some of the Services as we deem necessary without prior notice to the Users.

Article 5 (Membership Registration)

1. Membership Qualification
   Customers who consent to these Terms of Use and complete the Membership registration process on this Site shall hold membership on completion of said process. The Membership registration process shall be carried out by the Member themselves; Membership registration carried out by a substitute shall not be accepted. Moreover, we reserve the right to not accept Membership registrations by those who have had their membership canceled in the past, or we have otherwise deemed unsuitable.
   
   
2. Inputting Member Information
   When completing the Membership registration process, the applicant shall read the precaution notes concerning input, and then carefully fill out the specified form with the necessary details. Special characters, traditional script, roman numerals or other non-standard characters cannot be used when registering Member Information. If these characters are accidentally registered, we will change the characters concerned in house.
   
   
3. Password Management
   A password can only be used by the Member themselves, and must not be transferred or loaned to a third party.
   
   Members shall take responsibility for managing their own password, such as changing their password regularly.

Any and all declarations of intent made after a Member has inputted their password in this Site are considered as declarations of intent of the Member themselves, and all payments, etc. generated therefrom are the responsibility of the Member.

Article 6 (Changes to Member Information)

1. If there is any change to Member Information registered in accordance with the preceding article, the Member shall change their Member Information on this Site promptly.
   
   
2. We will bear no responsibility for any damages incurred as a result of failing to register changes as set forth in the preceding clause. Moreover, even if a change has been registered, any transactions which were processed prior to registering this change shall be carried out based on the information prior to registering the change.

Article 7 (Membership Cancellation)

If a Member wishes to cancel their Membership registration for this Site, the Member themselves shall proceed with the cancellation process following our set procedures, when completed, the membership will be canceled.

Article 8 (Loss of Membership)

1. If a Member has made a false statement during the Membership registration process or has otherwise given us reasons to determine them to be unsuited as our Member, we may revoke the Membership.

Article 9 (User Indemnity Liability)

If the User behaves in a manner set forth in any of the following, said User shall be responsible for compensation for damages incurred by us as a result.

⑴ If the User is a Member, inappropriate use of the Member number or password.
⑵ Accessing this Site and tampering with information, sending a harmful computer program to this Site, or otherwise obstructing the operation of our company
⑶ Acts that infringe upon the trademarks or other intellectual property rights of the products we carry
⑷ Other acts that contravene these Terms of Use, or general public order and standards of decency

Article 10 (Handling of User Information)

We shall manage the User Information in accordance with the "Privacy Policy" of this Site.

Article 11 (Notifications and Communication)

Notifications and communication between the Users and us shall be carried out in accordance with our set procedures.

Article 12 (Prohibited Matters)

Users are prohibited from carrying out the following acts when using the Services.

⑴ Acts that breach laws and ordinances or these Terms of Use, or the cautionary points for using the Services or shopping through the Services, or our other designated Terms or regulations, etc.
⑵ Acts that will harm our rights, interests, or reputation, or those of a third party
⑶ Acts that may adversely impact on the physical or mental health of adolescents or otherwise contravene public order and standards of decency
⑷ Acts that cause trouble for other Users or third parties, or make them feel uncomfortable
⑸ Inputting false information
⑹ Transmitting or uploading harmful computer programs, emails, etc.
⑺ Unauthorized access of our server or other computers
⑻ If the User is a Member, lending or transferring their password to a third party, or sharing their password with a third party
⑼ Other acts deemed unacceptable by us

Article 13 (Disclaimers)

1. We assume no responsibility whatsoever for any damages generated due to system interruptions, delays, cancellations, loss of data, or unauthorized access to data caused by failure of communication lines or computers, or any other damages suffered by Users pertaining to our services.
   
   
2. We make no guarantees that emails or other content sent from our website, server, domain, etc. are free of computer viruses or other harmful content.

Article 14 (Revisions to the Terms of Use)

We shall have the right to revise these Terms of Use at our discretion, or to establish supplementary terms (hereafter "Supplementary Terms"). Revisions or supplements to these Terms of Use shall take effect from the point at which the revised Terms of Use or Supplementary Terms are posted on this Site. In such a case, Users shall comply with the revised Terms of Use or Supplementary Terms.

Article 15 (Governing Law, Jurisdictional Court)

1. These Terms of Use shall be governed by and interpreted in accordance with the laws of Japan. The United Nations Convention on Contracts for the International Sale of Goods (the Vienna Convention) shall not apply to the sale and purchase of goods in connection with the Services.
   
   
2. All lawsuits or disputes arising in connection with these Terms of Use shall be submitted to the exclusive jurisdiction of the Osaka District Court in the first instance.
